Which accessibility statement do I need?

Statement under BITV 2.0, information under § 14 BFSG or a voluntary statement – what the type depends on and what the applicability check decides.

“Accessibility statement” is an umbrella term. Legally, these are different documents with different mandatory content. The service generates the right one from two details you enter in the website’s “Settings”.

The three types

The voluntary statement claims neither a duty nor that none exists. It says “voluntary” – nothing more.

Detail 1: who declares

“Who is declaring” holds the name of the responsible body and the “Type of body”: public body, or private sector and everyone else. The page explains how to recognise a public body – not by legal form, non-profit status or size, but by its tasks, funding and supervision.

This detail belongs to the website, not the account. If an agency manages a client’s website, the client is named there: Managing websites for clients.

Detail 2: the applicability check

For websites in Germany and Austria that are not run by a public body, the service asks: “Is this offering covered by the law?” You tick which of the listed services are provided through the offering. In Germany, under the BFSG, these include:

  • telecommunications services,
  • elements of passenger transport services – timetables, booking, electronic tickets,
  • consumer banking services,
  • e-books and dedicated software,
  • e-commerce services – online shop, booking or ordering flow, any consumer contract concluded through the website.

There is also the question whether you are a micro-enterprise: fewer than 10 employees and an annual turnover or balance sheet total of at most €2 million. Micro-enterprises are exempt from the requirements for services.

If none applies, leave everything unticked – that is an answer, not a gap. Under the result, the page shows which document is generated. Your answer is recorded with a date.

As long as the question is open, a voluntary statement is generated, and it cannot be published. The service does not claim a duty nobody has checked.

Other countries

The legal basis per country – standards, document type, responsible bodies and their change history – is published under legal data. For procurement in the US, the service also generates an Accessibility Conformance Report in VPAT format from the same scan.

Language of the statement

Statements are currently generated in German. A statement is a legally shaped document; another language version is a separate template with its own review, not a translation.
